Overview

This paper on free, prior and informed consent in Australia describes legislation that applies in the Northern Territory of Australia, in particular the Aboriginal Land Rights (Northern Territory) Act 1976 (Commonwealth) (ALRA), which provides for special rights related to indigenous land ownership and mining. The legislative provisions and related practice are considered in terms of how, and the degree to which, they give effect to the right to ‘free, prior and informed consent’ (FPIC).
